Murray successfully brings Motion for summary Judgement on behalf of Town of Milton

In February 2009, J. Murray Davison successfully brought a motion for Summary Judgment on behalf of the Corporation of the Town of Milton. The Town issued a remedial Order pursuant to section 15.9 of the Building Code Act. The plaintiff failed to remedy the default and the Town retained a contractor to perform the work. The Town sought repayment for the remedial work and ultimately added the amount owing to the property owner’s tax roll. The property owner sued the Town for negligence in paying the contractor who effected the remedial work and sought an Order removing the costs incurred by the Town from its property tax. The Honourable Justice Quigley found that there was no genuine issue for trial since the Town had acted in accordance with its statutory powers. The Court of Appeal upheld Quigley J.’s decision.

Tim Trembley speaks at Conference on International Aviation Liability and Insurance

Tim Trembley spoke at the International Aviation Liability and Insurance Conference on October 31, 2009. His topic was the “Liability of Manufacturers of Aircraft, Engines and Component Parts”; specifically looking at issues regarding liability exclusion, jurisdiction and choice of law clauses.
